Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes the rules and guidelines for using the BrokerageAudit platform and services (the "Service") provided by BrokerageAudit, Inc. ("BrokerageAudit," "we," "us," or "our"). This AUP is incorporated by reference into our Terms of Service.

By using the Service, you agree to comply with this AUP. Violations may result in suspension or termination of your account.

1. Prohibited Conduct

You may not use the Service to:

1.1 Illegal Activity

  • Violate any applicable federal, state, or local law or regulation, including insurance regulations
  • Facilitate fraud, misrepresentation, or deceptive business practices
  • Forge, alter, or fabricate insurance documents, certificates, or policy information
  • Process or store documents related to money laundering, sanctions violations, or other financial crimes
  • Infringe upon the intellectual property rights of others

1.2 System Abuse

  • Attempt to gain unauthorized access to the Service, other user accounts, or connected systems
  • Upload files containing viruses, malware, ransomware, or other malicious code
  • Use the Service to conduct denial-of-service attacks or other disruptive actions
  • Circumvent or attempt to circumvent usage limits, rate limits, or access controls
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
  • Use automated tools (bots, scrapers, crawlers) to access the Service other than through our published APIs

1.3 Misuse of AI Features

  • Submit deliberately misleading or fabricated documents to manipulate AI analysis results
  • Use AI-generated outputs to create fraudulent insurance documentation
  • Attempt to extract, replicate, or reverse engineer the AI models or prompts used by the Service
  • Use the AI features for any purpose other than legitimate insurance agency backoffice operations

1.4 Unauthorized Commercial Use

  • Resell, sublicense, or redistribute access to the Service without our prior written consent
  • Use the Service to build a competing product or service
  • Share account credentials with individuals outside your Agency
  • Use the Service to provide document processing services to parties that are not part of your Agency, except as explicitly permitted by your plan

2. Content Standards

2.1 Uploaded Documents

The Service is designed to process legitimate insurance documents. All documents you upload must be:

  • Authentic insurance documents or materials directly related to your Agency's insurance operations
  • Documents that you have the legal right to upload and process
  • Free of malicious code or executables

2.2 Prohibited Content

You may not upload or process:

  • Forged, counterfeit, or intentionally altered insurance documents
  • Content unrelated to insurance operations (e.g., personal documents, non-business files)
  • Documents containing personal health information (PHI) protected under HIPAA, unless you have a valid Business Associate Agreement with us
  • Content that is obscene, defamatory, threatening, or harassing
  • Any content that violates applicable data protection or privacy laws

3. Resource Usage

You agree to use the Service's resources responsibly:

  • Stay within the document processing limits of your subscription plan
  • Do not upload excessively large files designed to consume disproportionate processing resources
  • Do not make excessive API calls that could degrade the Service for other users
  • Use storage for legitimate insurance documents, not as a general-purpose file hosting service

4. Security Requirements

As a user handling sensitive insurance data, you are expected to maintain reasonable security practices:

  • Keep your account credentials confidential and do not share them
  • Use strong, unique passwords or SSO for authentication
  • Promptly report any suspected unauthorized access to [email protected]
  • Ensure that devices used to access the Service are reasonably secured
  • Revoke access for users who leave your Agency or no longer need access

5. Enforcement

5.1 Monitoring

We reserve the right to monitor use of the Service for compliance with this AUP. We may use automated tools to detect suspicious activity, excessive usage, or policy violations. Monitoring is conducted in accordance with our Privacy Policy.

5.2 Consequences of Violation

If we determine that you have violated this AUP, we may take one or more of the following actions at our discretion:

  • Issue a written warning specifying the violation
  • Temporarily suspend your access to the Service while we investigate
  • Remove or disable access to content that violates this AUP
  • Permanently terminate your account for serious or repeated violations
  • Report illegal activity to appropriate law enforcement

For minor or first-time violations, we will generally attempt to notify you and provide an opportunity to correct the issue before taking enforcement action. However, we reserve the right to act immediately without notice for serious violations that pose a risk to the Service, other users, or third parties.

5.3 Appeals

If you believe that enforcement action was taken in error, you may appeal by contacting us at [email protected] within 30 days of the action. We will review your appeal and respond within 15 business days.

6. Reporting Violations

If you become aware of any violation of this AUP, please report it to us immediately:

We take all reports seriously and will investigate promptly. You will not be penalized for reporting violations in good faith.

7. Changes to This Policy

We may update this AUP from time to time. When we make material changes, we will notify you by email or through a prominent notice in the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated AUP.
